City ordinance prohibits homeowners from installing any structure in the public right-of-way with limited exceptions outlined in Chapter 23 of the City of South Portland Code of Ordinances (PDF). The public right of way may extend beyond the edge of a paved road or sidewalk.
The city shall not be liable for damages to such structures if left in the public right-of-way. (City of South Portland Code of Ordinances, ch. 23, sec. 23-11) It is the responsibility of the homeowner to familiarize themselves with their land boundaries and move their personal property within those boundaries.
